A completed form must be on file for each Participant prior to the start of the Activity or the Participant will not be able to participate in the Activity.
I understand, acknowledge, and agree to the following:
1.In consideration for my being allowed to participate in this Activity, I, the undersigned, do voluntarily agree to hold the City of Pasadena, its City Council members, and its officers, employees, commission members and representatives harmless from any claim, demand or cause of action for injury to me or damage to personal property (including attorney’s fees) which arises out of or is in any way connected with my participation in the above-mentioned Activity. The City of Pasadena will not be responsible in case of accident, illness or property damage.
2.Further, I specifically agree to indemnify and hold harmless the City of Pasadena, its City Council members, and its officers, employees, commission members and representatives against any and all liability, claims, personal or psychological injuries, demands, expenses (including attorney’s fees), fees, fines, penalties, suits, proceedings, actions and causes of action of any kind and nature, including, but not limited to, my negligence, arising or growing out of or in any way connected with the Activity.
3.There are inherent risks and dangers involved in riding a motorcycle, and in riding a motorcycle in a group event. These dangers include, but are not limited to, property damage, physical injury and death. Knowing and appreciating these dangers, I agree that my participation is voluntary and that I assume all responsibilities and risks associated with my participation in the Activity.
4.This hold harmless agreement includes without limitation claims for bodily injury, death, or damage to property, losses, judgments, fines, penalties, liabilities, costs and expenses of every kind and nature whatsoever which relate to my participation in the Activity.
5.This Agreement is binding upon and shall inure to the benefit of all parties to this Release of Liability, and their representatives, agents, employees, attorneys, officers, directors, subsidiaries, heirs, successors or assigns.
6.Waiver by any party of any one or more of the conditions of performance under this Release of Liability shall not be a waiver of any other condition of performance under this Agreement.
7.By signing this Release of Liability, I certify the following as of the date of my signature:
a.I am at least 18 years of age;
b.If I am female, I am informed of and understand that participating in this activity while pregnant may not be medically advisable and have been told I should not participate in this activity if I am or may be pregnant;
c.I am not currently suffering from a back ailment or injury;
d.I am not recovering from any recent ailment, injury, or surgery that would prevent me from safely participating in this activity and have not been instructed by any doctor or medical professional to avoid riding motorcycles or engaging in other activities that would be required by my participation in this activity;
e.I am not under the influence of any alcohol, prescription medication, or any other substance that would affect my driving ability;
f.The motorcycle I am using for this training is in good working order. I will provide all of my own personal safety gear such as a DOT approved helmet and protective clothing suitable for motorcycle riding;
g.I have a valid driver’s license and a valid motorcycle license endorsement. I am authorized by my employing law enforcement agency to ride a police motorcycle, and have obtained approval from my employing law enforcement agency to participate in this Activity;
h.I will not engage in reckless riding in the form of “wheelies or stoppies;” or any other type of riding deemed unsafe or reckless by course instructors. I understand that if I violate these terms I will be immediately dismissed from the course;
i.Any photographs or videos that I take will be for personal use only and not for any type of commercial use whatsoever;
j.I will not engage in any abusive or demeaning conduct towards other participants or facilitators of the Activity. I will not make any offensive statements to any participant or staff members along the grounds of any protected class under California law. I understand that if I violate this clause (and any other clause of this waiver) I may be immediately dismissed from the course;
k.I will follow all of the course rules as it applies to riding instructions, flow of patterns, “rules of the road / course,” or any other safety mechanism / instruction as directed by facilitators of the Activity;
l.I accept this Release of Liability in its entirety and not portions thereof. If I do not agree to any statement in this document, I acknowledge the fact that I will be prohibited from participating in the course.
I hereby grant the City of Pasadena permission to interview me, and use my likeness in photograph(s)/video(s) in any and all publications and in any and all other media, whether now known or hereafter existing, controlled by Pasadena in perpetuity, and for other use by the City of Pasadena. I will make no monetary or other claim against the City of Pasadena for the use of the interview, survey and/or photograph(s)/video(s).
I, the undersigned, acknowledge that I have read the foregoing Release of Liability, and am fully aware of the legal consequences of signing this document. I understand that this document is written to be as broad and inclusive as legally permitted by the State of California.
I agree that this document will be considered signed by an original signature when the signature is delivered by facsimile transmission or scanned into an electronic file and transmitted by email or fax.
